It does not stop garnishment for child support or spousal support obligations, so the type of debt matters.

How Wage Garnishment Works in California

Before a private creditor can garnish wages in California, they must go through the court system: file a lawsuit, win a judgment against the debtor, and obtain an earnings withholding order directing the employer to withhold a portion of each paycheck. The creditor can’t skip any of those steps, which means there’s usually a window between when a judgment is entered and when garnishment begins.

California limits how much a private creditor can take. The garnishment is capped at the lesser of 20% of disposable earnings for the workweek, or the amount by which weekly disposable earnings exceed 40 times the state minimum wage. Disposable earnings are what remain after legally required deductions such as taxes. California’s formula frequently results in a lower garnishment amount than the federal default, but even a reduced garnishment can strain a household budget.

Not all creditors are subject to these limits. The IRS and the California Franchise Tax Board can issue earnings withholding orders directly without first obtaining a court judgment, and garnishment for tax debts follows different rules and timelines than garnishment by private creditors.

California allows debtors to file a Claim of Exemption (form WG-006) with the levying officer, along with a Financial Statement (form WG-007), arguing that the garnished wages are needed for basic necessities. If the creditor doesn’t object, the garnishment may be reduced or stopped. If the creditor objects, a court hearing is scheduled and a judge decides. A successful exemption claim addresses the immediate garnishment but doesn’t eliminate the underlying debt.

Negotiating with the Creditor
Direct negotiation for a lump-sum settlement or a voluntary payment plan can stop garnishment without court involvement. Whether this works depends on the creditor’s willingness, and any agreement should be documented carefully. Like an exemption claim, a negotiated settlement resolves the garnishment but leaves the debt to be addressed through payment rather than discharge.

Vacating the Judgment
In California, a default judgment may be vacated if the debtor can show that service of process didn’t result in actual notice in time to defend the lawsuit, or that the default resulted from mistake or excusable neglect. If the judgment is vacated, the garnishment stops, but the creditor can refile the lawsuit. Vacating a judgment is the beginning of a legal contest, not necessarily the end of one.
